2. Cookies and Similar Technologies
2.1. General Information
Nintendo may place cookies on its website. Cookies are small files downloaded to your
device. Cookies could be used to ensure the safety and smooth functionality of our
website (strictly necessary security cookies and session cookies) and to collect
information about the preferences of our online visitors in order to make our online
offers more attractive for our users (non-essential cookies). Most browsers are
automatically set to accept cookies. You can choose which types of cookies shall be
allowed on your device. With the exception of strictly necessary cookies that are required
for the operation of the website (more information below), cookies will only be activated
if you explicitly allow it.
2.2. Strictly Necessary Cookies
Nintendo employs security and session cookies that are strictly necessary to provide you
with the services you have requested. For example, Nintendo employs session cookies
to store your selections whilst you navigate to different pages and to provide access to
secure areas of the website. If you are located in a country of the European Union or in
the UK, the legal basis for using strictly necessary cookies is the provision of the service
you have requested (Art. 6 para. 1 (b) GDPR).
2.3. Non-essential Cookies
Nintendo of Europe SE (“Nintendo of Europe”), Goldsteinstrasse 235, 60528 Frankfurt
am Main, Germany, is responsible for the usage of the cookies which are listed in this
section 2.3 of the Privacy Policy. Nintendo neither controls the means nor the purposes
of any data processing related to these cookies.
For information on the contact details of Nintendo of Europe’s data protection officer
and for information on your rights you may have under GDPR vis-à-vis Nintendo of
Europe, please see Website Privacy Policy | Legal Information | Nintendo UK
(https://www.nintendo.com/en-gb/Legal-information/Website-Privacy-Policy/Website-
Privacy-Policy-637785.html).
With your consent Nintendo of Europe employs the following non-essential cookies on
the website:
2.3.1. Google Analytics
With your consent, Nintendo of Europe uses Google Analytics, a web analytics service
provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5,
Ireland (“Google Ireland").
Google Analytics uses cookies, which are text files placed on visitors' computers, to help
Nintendo of Europe analyse how visitors use the website. The information generated by
the cookie about the visitors' use of the website will generally be transmitted to and
stored by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA
(“Google") on servers in the United States. On this website, IP anonymisation has been
activated. The IP addresses of users from European Union member states, from other
states contracting to the Agreement on the European Economic Area, or from the United
Kingdom, will be shortened. Only in exceptional cases will a complete IP address be
transferred to a Google server in the United States and shortened there. On behalf of
Nintendo of Europe, Google Ireland will use this information for the purpose of
evaluating the website for Nintendo, in order to compile reports on website activity, and
to provide other services relating to website activity and internet usage for Nintendo of
Europe. Google Ireland will not associate the IP address transferred in the context of
Google Analytics with any other data held by Google Ireland. For further information
please visit https://support.google.com/analytics/answer/6004245.
If you are located in a country of the European Union or in the UK, the legal basis for
enabling Google Analytics and for the subsequent processing of the data collected via
Google Analytics such as usage, analysis and storage is your consent (Art. 6 para. 1 (a)
GDPR). Google Analytics will only be activated if you explicitly allow it. If you permitted
the use of Google Analytics, you can withdraw your consent and disable Google
Analytics at any time by updating your cookie settings below. Alternatively, Google
Analytics can be deactivated by downloading and installing a browser plug-in through
the following link: https://tools.google.com/dlpage/gaoptout.
This website uses “Google Signals”. Google Signals is an update provided by Google
Ireland as part of Google Analytics and enables a cross device tracking only of those
users who are logged into their Google account and who have activated “Ads
Personalization” in their Google account settings. When using Google Signals
aggregated data such as enhanced reports on demographics and interests from website
users who are logged into their Google account and who have activated “Ads
Personalization” in their Google account is included in Google Analytics reports. The
aggregated data Google Signals generates for Nintendo allows for Nintendo to serve
ads to users in cross-device remarketing campaigns, but does not allow Nintendo to
infer the identity of any such user. On an aggregate basis, Google Signals provides
Nintendo with information about how a visitor interacts with this website from multiple
browsers and multiple devices.
Google account users can control their advertisement experience and can deactivate
“Ads Personalization” at any time in their Google account settings.
2.3.2. Google Marketing Platform/DoubleClick
With your consent, Nintendo of Europe uses DoubleClick by Google Ireland on this
website. DoubleClick by Google Ireland uses cookies to provide website visitors with
relevant advertisements. A cookie ID is assigned to your browser to keep a log of which
advertisements have already been delivered to that particular browser. The DoubleClick
cookie enables Google Ireland and its partner websites to show advertisements based
on former visits on this or other websites. In the same way, the cookie ID allows the
DoubleClick cookie to log conversions related to advertisement requests - such as when
a user views a DoubleClick advertisement and later uses the same browser to visit the
advertiser’s website.
If you are located in a country of the European Union or in the UK, the legal basis for
enabling the DoubleClick cookie and the subsequent processing of the data collected
via the DoubleClick cookie by Nintendo of Europe is your consent (Art. 6 para. 1 (a)
GDPR). Nintendo of Europe will only use DoubleClick if you explicitly allow it. If you
permitted the use of DoubleClick, you can withdraw your consent and disable
DoubleClick at any time by updating your cookie settings below. Alternatively, the
DoubleClick cookie can be deactivated by installing the DoubleClick browser plug-in
through the following link: https://www.google.com/settings/ads/plugin or by updating
the settings on the following website: https://www.google.com/settings/ads.
2.3.3. Google Ads Remarketing
With your consent, on this website Nintendo of Europe uses the Google Ads
Remarketing technology which is a service from Google Ireland. Advertisements can be
presented within the advertising network of Google / Google Ireland based on content
which has previously been accessed on websites within the Google / Google Ireland
advertising network by visitors that are also using the Google Ads Remarketing feature.
In particular, based on your prior use of this website Nintendo of Europe uses Google
Ads Remarketing to target its ads to you when you visit other websites, e.g. sites in
Google’s / Google Ireland’s content network.
If you are located in a country of the European Union or in the UK, the legal basis for
using Google Ads Remarketing and the subsequent processing of the data collected via
Google Ads Remarketing such as usage, analysis and storage is your consent (Art. 6 para.
1 (a) GDPR). Nintendo of Europe will only use Google Ads Remarketing if you explicitly
allow it. If you permitted the use of Google Ads Remarketing, you can withdraw your
consent and disable Google Ads Remarketing at any time by updating your cookie
settings below. Alternatively, Google Ads Remarketing can be deactivated by updating
the settings under http://www.google.com/settings/ads.
When you access this website while logged into your Google account and when you
have chosen to enable Google / Google Ireland to associate your browsing history with
your Google account and to use such information to personalise advertisements, Google
/ Google Ireland associates information collected through Google Analytics to your
Google account data. Google / Google Ireland will use the collected information for
cross-device marketing issues. In particular, based on your use of this website on one
device our advertisements can be targeted to you when you browse on another device.
The data collected by Google / Google Ireland on this website about Google account
users allow for Nintendo no conclusion as to the identity of any Google account user.
You can find additional information about the collection and use of data by Google /
Google Ireland under http://www.google.com/policies/privacy/.
Google account users can control their advertisement experience and modify their
settings with respect to personalised advertisements at any time in their Google account
settings.

The Meta pixel collects and processes the following information (called “Event Data”):
Information about actions and activities of the visitors of our website, such as
searching and viewing a product or purchasing a product;
Specific pixel information such as the pixel ID and the Facebook cookie;

We have no influence on the scope and subsequent processing of the submitted Event
Data by Meta. Meta may process the information to create or enrich user profiles. If you
are registered with a Meta service such as Facebook or Instagram, Meta may associate
the Event Data (including the visit on our website) with your account. Even if you are not
registered with a Meta service or have not logged in, it is possible that Meta may learn
your IP address and other identifying information and use it to create a profile. For more
information about how Meta processes user profiles and your personal data, including
the purposes, legal basis on which Meta relies and how you can exercise your rights
against Meta, please see Meta Privacy Policy at
https://www.facebook.com/about/privacy.
We have also engaged Meta to prepare reports on the impact of our advertising
campaigns and other online content based on the Event Data collected through the
Meta pixel (“campaign reports”) and to provide analysis and insights about the visitors
and their use of our website, products and services (“analytics”). We transfer personal
data contained in the Event Data to Meta for these purposes. The transferred personal
data is processed by Meta as our processor to provide us with campaign reports and
analytics.
Please note that Meta may transfer processed data also to servers outside the EU, in
particular to Meta Platforms, Inc. in the USA. Such data transfer is based on Art. 45 para.
1 GDPR, as Meta Platforms, Inc. is certified under the EU-U.S. Data Privacy Framework
and is also registered in the list maintained by the U.S. Department of Commerce (Data
Privacy Framework List). The EU-U.S. Data Privacy Framework is an adequacy decision by

commissioned processing of personal data by Meta for the creation of analyses and
campaign reports is your consent (Art. 6 para. 1 (a) GDPR). We will only use the Meta
pixel if you explicitly allow it. If you permitted the use of the Meta pixel, you can withdraw
